"System" - A linear method of trying to control non-linear events. Systems are always going to be imperfect, and therefore inadequate for dealing with all situations. One system for all situations is just impossible.
The freedoms that we experience in America are not "FREEDOM" in the total sense. FREEDOM is the ability to do as one chooses. We are granted a type of freedom that has exceptions and clauses in this country. Not every situation or every person is entitled to FREEDOM under the laws of this country.
The problem arises in the balance between personal liberties and societal safety. I personally think that everyone should have the liberty to do what they will, and ultimately we all do, it is just a matter of consequences. But when you're in the position of measuring the liberty of the one against the safety of the many...and making laws to protect the many while still maintaining the most liberty and justice for all...well, that's a whole new balancing act.
In the above instance, (the party being busted) yes, there is the risk of sending everyone from the party on the road under the influence. However, it is still not legal to be there, be under the influence and drive, or possibly even to have done whatever it is that is altering your ability to be responsible for yourself. So, what then? Are the police supposed to give the benefit of the doubt and assume that everyone is responsible enough to make the right decisions and NOT put themselves and others at risk? Or should they just crack a beer and play babysitter for the minority while turing a blind eye to the majority?
Not every method works for every instance. In the illegal rave sense, sometimes we are lucky, sometimes we are not. Somtimes we outsmart those who wish us to fail, sometimes we do not.
Either way, we are luckier than most in most all other instances. Besides, getting away with it would not be nearly as fun or challenging if it were not for the risks involved...rafe is like sex, you only get out of it what you put in. If it were always easy you'd get bored.
